Here's the response I got from BMW NA today regarding seat/mirror linking to the remote. I am pissed, needless to say:
"The key and seat memory feature was not available for E90 3 Series vehicles produced prior to 9/05. BMW is currently looking into the availability of a software update in the future that will allow this feature for your vehicle. The RDS feature was also not available at the time your vehicle was produced, however, there has been a recent software release that will activate this feature on your vehicle."
This says to me the "September update" won't bring pre-09/05 cars up to the same functional level as post-09/05 cars. This particular feature is documented in the book and the brochure. I can't believe they sold me something that might now never work.

That would be very bad for BMW......You can't do that without getting sued.

sounds funny, I bought my 330i (in Hong Kong) and it's in the first few batches of production. no mirror and seat memory linked to remote at that time. 2 months ago I brought back my car to the dealer and they had software upgrade to enable it, together with the automatic lock.

They in no way said it might never work. | Well, we're parsing the meaning of a portion of an email message to me which I suspect was written less carefully than we are giving it credit for.
What I read is there are TWO updates: one fixes RDS; the other -- which isn't a certain thing -- might fix the seat memory problem.
My point is: how do we accurately find out what's in the "September update?" One way to read this message is the "RDS fix" is currently available. Nothing I've seen here indicates this; in fact everyone has suggested it's part of the September update, and not a separate thing
