I have ordered the 325xi about a month ago and put $1000 for deposit. The sales person told me there was no room for negotiation because there is such a high demand and waiting list. So i got the 325xi in alpine white, automatic, leatherette, xenons, navigation, upgraded rims for $300, BMW assist with bluetooth, sports package, power seats w/memory totalling $40,615 ($200 under MSRP). Can i negotiate this when the car comes in; The sale is not final yet...please help me!

Ouch! $200 under MSRP that is terrible!
I would get the deposit back, tell them you changed your mind, or your dog died or something!
You should be able to get a deal closer to $1000 over invoice, which would be about $2500 less than what you are going to pay for that one!
Dont even discuss the MSRP price, start at the Invoice and work up!

i think the car is in production now, what should i do? Cancel and reorder somewhere else or negotiate with this dealer once the car is in?

You will be getting one of the first 325xi in the country. You're also getting the car equipped exactly as you'd like (and the configuration you ordered isn't likely to be found just sitting on a dealer lot). I'm guessing the New York market for BMWs is like the market for all other goods in that area, which is to say high.
You have every right to cancel your order and get it somewhere else.
But to come back to the table and try to renegotiate is simply bad business. How would you feel if they raised the price on you to $5k over sticker once the car came in?

You can cancel anyway, the dealer should be able to sell that car once it gets to the lot.
The dealer doesnt want to loose your business so they wont want to give your deposit back, but you can get it back! The deal you were offered is just not good enough to go through with.
Did you put the Deposit down by Credit card?? I hope!? It would be really easy to dipute the charge if the dealer isnt willing to give the deposit back right away

My car was, in fact, produced after the price increase but that's not the price we agreed to. Know what they told me? "Nothing's final until the sales agreement's signed." Which is exactly what I go by now .... worked against them anyway, I ended up negotiating down another $2200 on the deal because they didn't want a convertible with a manual transmission sitting on the lot.
The whole deposit, agree to a price thing is to protect the dealer. I personally don't find it dishonest or unethical to renegotiate the price when the car comes in ... but I'll make sure the sales person is very aware that we'll talk final price once they have a product for me to purchase. I'm not ordering a custom tailored suit. I'm being forced into ordering a car because BMW's business model doesn't want excess inventory (at least in my area). Now if it were an 'individual' car that'd be different. I don't find anything special about choosing a combination of run of the mill production options ... eventhough I'm sure they like to foster that feeling that you're getting something "custom"l.
Okay rant done. In this situation you should probably suck it up and call it a lesson learned. Doubt they'd deal too much on one of the first XI's with winter right around the corner. They'll be able to sell it the same day it hits the lot.
